What is CE Marking?

UKCA marking is mandatory by law for cups that are being used in licenced establishments to sell by measurements. This ensures the measure being served complies with UK directives. As the UK has now left the EU, the capacity verification mark will change from a CE mark to a UKCA mark for the UK market, both marks mean the same thing.
You can no longer use a CE marked cup in the UK from a European supplier. The UK has left the European Union. As a result, from 1 January 2023, importers and manufacturers must affix the UKCA mark on their products or packaging, as the CE mark will not be accepted.
If you do not comply with the requirements as detailed in Regulations and Orders made under the Weights and Measures Act 1985 and the Licensing Act 2003 at your festival or event this could result in equipment being forfeited and prosecution. On conviction the courts may impose a fine of up to £2,000. Breaches of licence conditions can lead to a licence review and revocation as well as a fine of up to £20,000.
The Weights and Measures Act 1985 requires that the sale of alcohol be measured by one of three ways: the container (eg. bottle), bar cup (CE marked pint to the line cup), or the pouring method (eg. MDU). This means that if there is any doubt about the size of cup(s) being presented for reuse at a bar, ie. if it is not CE-marked, the bar is responsible for ensuring the correct measurement of liquid.
